Thank you for choosing Hollar Fence for your fencing needs. We stand behind the quality of our workmanship and are pleased to provide the following limited express warranties (together, the “Warranties”) of our workmanship beginning on the date of completion of the installation of your fence:

3-Year Limited Workmanship Warranty

The 3-Year Limited Workmanship Warranty covers defects in workmanship that may result in structural failure of the fence (excluding gates, if applicable), which are limited to:

• Fence panels separating from posts due to improper fastening

• Posts leaning or shifting due to an insufficient amount of concrete or improper setting depth

• Pickets detaching on their own due to installation error

• Gates sagging, binding, or failing to latch properly due to improper installation

• Rails detaching from posts due to inadequate fastening

• Improper alignment or spacing of posts, rails, or pickets resulting in structural instability

• Loose or missing fasteners attributable to installation error

• Uneven fence height or grade alignment caused by improper installation techniques

1-Year Limited Gate Warranty

The 1-Year Limited Gate Warranty covers defects in workmanship that may result in failure to the gate, which are limited to:

• Gate alignment that prevents proper opening, closing, or latching, or non-functionality of hinges and latches, due to workmanship

• Structural integrity of the gate due to installation error

• Failure of fasteners, brackets, or hardware caused by improper installation

• Detachment of gate components (including rails, pickets, or panels) due to installation error

Warranty Terms

Express Warranty
Subject to the terms, limitations, and exclusions set forth herein, if any of the above defects under the 3-Year Limited Workmanship Warranty arise within the 3-year warranty period as a result of our workmanship or if any of the above defects under the 1-Year Limited Gate Warranty arise within the 1-year warranty period as a result of our workmanship, we will perform an inspection of the services, and, in our sole discretion, repair or replace the affected portion of the work within a reasonable period of time. The corrective re-performance above due to our workmanship shall be your exclusive remedy under these Warranties.

The Warranties are valid only if you notify us in writing within 30 days from discovery of any alleged defects subject to the Warranties and the request in writing is made while the applicable warranty is in effect (3-years for Limited Workmanship Warranty; 1-year for Limited Gate Warranty). The Warranties will be deemed null and void if (i) all payments due under the Agreements were not timely made to us, or (ii) any modifications, attachments, or alterations are made to the fence after our completion of the services.

The 3-Year Limited Workmanship Warranty and 1-Year Limited Gate Warranty apply solely to workmanship-related issues, and therefore do not apply to defects or damage caused by (i) weather events or acts of God, (ii) incidental or intentional damage caused by you, third parties, or animals, (iii) ground shifting or soil movement including post leaning due to soft or unstable soil conditions, (iv) post-substantial completion modifications, alterations, repairs, or adjustments by you or third parties, or (v) any condition or damage beyond our reasonable control.

The Warranties are provided solely to the original Customer named in the Agreements and are not assignable or transferable to any subsequent owner, purchaser, or other third party. Any attempt to transfer or assign this warranty shall be void and of no effect.

The Warranties are expressly limited to the scope of coverage(s) provided herein, are subject to the disclaimers/waivers in the Agreements (the terms of which are incorporated herein by reference), and do not modify or create any other express or implied warranties. All implied warranties, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and workmanship, are expressly disclaimed to the fullest extent permitted by applicable law.
